Media Advisory: Mention of Petition 606 of 2014 on Forced and Coerced Sterilization of Women Living with HIV

What: The High Court in Nairobi (Constitutional and Human Rights Division) will on Monday, 8 February, 2016 mention Petition No. 606 of 2014 to give directions on the hearing of the case. This is after the court gave a ruling that allowed the enjoinment of Prof Alicia Ely Yamin as a friend of the court. The Court will also consider and give directions on an application by the National Gender and Equality Commission (NGEC) to be enjoined as a friend of the court.

Why: The court had on 28 January, 2016 dismissed an application by Marura Maternity and Nursing Home seeking to have Price Water House Coopers and the Project Manager- OBA RH enjoined onto the case stating that no authorities were placed before it to support the applicability of third party proceedings in constitutional litigation.  The application by Prof. Alicia Ely Yamin to be enjoined as friend of the court was allowed.
