Parties Set to make final submissions in Cases Challenging the Forced and Coerced Sterilization of Women Living with HIV On 19th July 2021

The High Court of Kenya has set the date of 19th July 2021 for the parties involved in Petitions 605 and 606 of 2014 to highlight their respective submissions. The two cases that were filed in 2014 challenge the forced and coerced sterilization of five women living with HIV.

In Petition 605 of 2014, the petitioners, 1st interested party, and the 2nd and 4th respondents and the 1st and 3rd amici curiae, have filed their written submissions. Although all respondents had been expected to have filed their written submissions by 30th April 2021, the 1st and 3rd  respondent sought a further 21 days to file their submissions. They will now be expected to file their submissions on or before 27th May 2021. Similarly, in Petition 606 of 2014, the petitioners have filed their written submissions as well as supplementary submissions. The court has directed the respondents, the amici curiae and the interested party to file their supplementary submissions by 24th May 2021.

The petitions have been before the court for over six years and the petitioners welcome the date set by the court for the highlighting of submissions with the hope that the matter will soon be concluded and that justice is served.

PLEASE NOTE: The petitioners request that their names and identity should not be disclosed in the media to protect them from further stigma and discrimination on the basis of their HIV status. They are therefore not available to give interviews.
