Court to Determine the Fate of Interested Parties and Friends of the Court for Petition 605 of 2014

The High Court in Nairobi (Constitutional and Human Rights Division) has directed that all parties seeking to be enjoined as Amicus Curiae (friends of the court) – or as interested parties – file their submissions before 13 April, 2016 when the matter will be heard.

The parties seeking to be enjoined are Professor Alicia Ely Yamin, International Community of Women with HIV–Global (ICW Global), International Community of Women with HIV – Kenya (ICW Kenya), the Joint United Nations Programme on HIV/AIDS (UNAIDS), and the National Gender and Equality Commission (NGEC). The court noted that only Médicins Sans Frontières (MSF) has opposed the applications for enjoinment but is yet to file its submissions.

Judge Lenaola further noted that the Preliminary objection filed by Marie Stopes International on 18 January, 2016 raised administrative concerns, which did not strictly pertain to matters of law. He advised them to file the relevant application. The Court will address this matter on 13 April, 2016.
