High Court Sets Hearing Date for Petition 606 of 2014

Constitutional and Human Rights Division Judge, Justice Isaac Lenaola, has fixed Petition No. 606 of 2014 for hearing on 3 May, 2016. This directive was issued following the mention before the Court today, 8 February, 2016. All parties are therefore expected to file their responses to the amended petition and written submissions with the court before the hearing date.

During the mention, the Court allowed the application by the National Gender and Equality Commission (NGEC) to be enjoined as Amicus Curiae (friend of the court). NGEC now comes aboard alongside Professor Alicia Ely Yamin, International Community of Women with HIV – Global (ICW Global), and the Joint United Nations Programme on HIV/AIDS (UNAIDS), who were already enjoined.

At end of the mention, Allan Maleche, advocate for the petitioners said,

“I’m glad the court has set this case for hearing. I expect all parties will comply with the direction of the court to ensure that the matter is expeditiously heard for the sake of the women I represent”.

The matter will therefore be heard on 3 May, 2016 at 9:00 am before Justice Isaac Lenaola.
