National Gender and Equality Commission expresses interest to join the two Sterilization cases

The National Gender and Equality Commission (NGEC) has today expressed its interest to join, as Amicus Curiae, in the cases before the High Court of Kenya on the Forced and Coerced Sterilization of Women Living with HIV. The Commission, through its Legal Officer, Mr. Sylvester Mbithi, had intended to make an oral application in court on 9th of December, during the Ruling of Petition 606 of 2014.

KELIN, and other parties to the case, were in court where it was expected that a ruling would be delivered to determine whether certain parties would be enjoined to the case.  The ruling, which was to be made by Judge Mumbi Ngugi, was in line with the previous application by Marura Maternity and Nursing Home, who had filed an application seeking to have Price Water House Coopers (PWC) and the Project Manager – OBA RH enjoined onto the case. Marura Nursing Home had argued that they were only an independent contractor and were approached by our client, based on the advice and assessment she had received from the intended interested parties on tubal ligation.

The court was, however, not sitting and the ruling was not delivered. KELIN will seek a fresh mention date at the earliest opportunity.
